Section 110, ss4 of the Act states that a constable may merely do such an apprehension where he has ââ¬Ëreasonable groundsââ¬â¢ for believing that such an apprehension is ââ¬Ënecessaryââ¬â¢ . Section 110, ss5 of the 2005 Act stipulates the valid grounds which may take to such a ââ¬Ëreasonable beliefââ¬â¢ in the necessity of the app rehension. Let us now consider whether there is any information within the facts of our instance which might propose that B was justified in doing his apprehension of P and S: We are non told the grounds behind the apprehension: we are told nevertheless that P and S refused both ââ¬Ëto disperse half the groupââ¬â¢ and ââ¬Ëto divert the March to climax some one and a half milesââ¬â¢ off from its proposed finish, at the central office of Cargo Ltd. However, it would be hard to reason that the apprehension of P and S would hold served to take this obstructor, and as such, whilst fulfilling the ground specifications of s110 ( 5 ) ( V ) of the 2005 Act [ ââ¬Ëcausing an improper obstructor of the highwayââ¬â¢ ] , an apprehension on this land would about surely be deemed improper due to s110 ( 4 ) which required B to hold an apprehension necessary in order to foresta ll the obstructor in inquiry, when clearly the apprehension would non, and did non [ the March go oning regardless of the absence of P and S ] , have this consequence.
